5 Fees & Payment Terms

5.1 Initial Consultations

Initial case evaluations and consultations provided by SSDI Services are offered free of charge and without obligation. We reserve the right to change this policy at any time, but changes will not affect evaluations already scheduled.

5.2 Paid Services

If you elect to engage our paid services, all fees will be clearly outlined in a separate Service Agreement provided to you prior to the commencement of any billable work. You will have the opportunity to review and accept all fees before incurring any charges.

5.3 Third-Party Fees

Certain aspects of the SSDI process may involve fees charged by third parties (e.g., medical providers for records, government agencies for filing, or referred attorneys for legal representation). We are not responsible for third-party fees, which will be clearly communicated to you when applicable.

5.4 Refund Policy

Refund eligibility for paid services will be governed by the specific terms outlined in the Service Agreement signed by both parties. Unless otherwise stated in that agreement, fees paid for services already rendered are non-refundable.

6 Intellectual Property Rights

All content, materials, and features on the Site—including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, page layout, underlying code, and software—are the exclusive property of SSDI Services or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial purposes related to engaging our Services. You may not:

  • Reproduce, distribute, publicly display, or exploit any content from the Site without express written permission.
  • Use our branding, logos, or trade dress in any manner that could cause confusion about the source of the material.
  • Frame, mirror, or embed any part of the Site on another website without prior written authorization.

7 User Submitted Content

By submitting information, documents, or other content to us through our forms, emails, or portals, you grant us a limited, worldwide license to use, store, process, and share that content strictly for the purpose of providing our Services to you.

You are solely responsible for the accuracy and completeness of the information you submit. You agree to promptly update us if any information you have provided changes.

Confidentiality: We take the confidentiality of your submitted documents seriously. All medical and personal records are handled in accordance with our Privacy Policy and applicable state and federal privacy regulations.

8 Disclaimers & Limitations

The Site and our Services are provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the Site's operation or the information, content, or materials included.

To the fullest extent permitted by applicable law, we expressly disclaim:

  • Implied Warranties of Merchantability: We do not warrant that the Site will be uninterrupted, error-free, or free of viruses.
  • Implied Warranties of Fitness: We do not warrant that the Site or content will meet your specific requirements.
  • Claim Outcomes: We do not guarantee the approval, denial, or specific timeline of any Social Security Disability Insurance claim. The SSA makes all determinations regarding benefit eligibility independently.
  • Legal Outcomes: If your case is referred to a third-party attorney, we are not responsible for the outcome of any legal proceedings.
  • Third-Party Accuracy: We do not warrant the accuracy, completeness, or reliability of any information provided by third parties, including government agencies.

9 Third-Party Services & Links

Our Site may contain links to third-party websites, including government sites (such as ssa.gov) and partner services. These links are provided solely for your convenience.

We do not endorse, control, or assume responsibility for any third-party websites, services, or content. Your interactions with third-party websites are governed by their respective terms and policies.

If we refer you to a third-party attorney or advocate, any agreement for services will be strictly between you and that third party. We are not liable for the conduct, advice, or performance of third-party providers.

10 Indemnification

You agree to defend, indemnify, and hold harmless SSDI Services, its affiliates, officers, directors, employees, agents, and contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to:

  1. Your use of or inability to use the Site or Services.
  2. Your violation of these Terms.
  3. Your breach of any representations or warranties made in these Terms.
  4. Your violation of any applicable laws or the rights of a third party.
  5. Information or content you submit through our Site or Services.

We will promptly notify you of any such claim and provide reasonable cooperation in your defense, at your expense.

11 Limitation of Liability

Critical Limitation: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SSDI Services, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

This limitation applies regardless of the legal theory under which such damages are sought, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, our liability shall be limited to the greatest extent permitted by law.

12 Dispute Resolution & Governing Law

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law principles.

12.2 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach thereof shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Washington, D.C.

12.3 Class Action Waiver

YOU AND SSDI Services AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN HIS OR HER INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

13 Modifications & Interruptions

We reserve the right to modify, suspend, or discontinue the Site or Services (or any part thereof) at any time without prior notice. We will make reasonable efforts to notify you of material changes, but we are not liable if you do not receive such notice.

We are not liable for any interruption, delay, or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

14 Termination

You may stop using the Site and Services at any time. If you have an active Service Agreement with us, termination of that agreement will be governed by the specific termination clauses within that document.

We reserve the right to suspend or terminate your access to the Site immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, warranty disclaimers, indemnification, and limitations of liability.

15 Severability

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
